Council Still Undecided As To Whether To Follow Judicial Decision

It’s been five months since a Calgary judge sent back the sanction for reconsideration by city council which prevents the mayor from communicating directly with staff.
It will be at least another two weeks before council gets around to discussing whether King’s Bench Justice Rosemary Nation’s court ruling should be followed, council heard Monday night.
In her August 2024 decision on sanctions against the mayor, Nation found city councillors, “appear to have no sense of proportionality in crafting sanctions and have imposed sanctions that have no rational connection with the breach of the code (of conduct).”
Nation overturned all the sanctions imposed on Linnsie Clark following an exchange with the city manager during an August 2023 council meeting save for an apology by the mayor to Ann Mitchell.
Nation sent back the sanction enacted in March 2024 that limited Clark’s ability to communicate with staff and has seen her locked out of portions of city hall for nearly a year.
“To prohibit her from entering the administrative area at City Hall or having contact with city staff is hard to relate to what was said and done or the tone in which it was said and done at the August meeting,” wrote Nation in her ruling.
Despite that ruling, Coun. Shila Sharps indicated in her notice of motion filed two weeks ago that not all councillors agree with that ruling.
That appeared to be clear by Coun. Darren Hirsch being the sole elected official to vote against even having a discussion as to whether sanction should be reconsidered.
Council will be debating whether or not to comply with Nation’s ruling at the in-camera portion of the next council meeting on Feb. 3.
