UCP MLA Uses Privileged Information, Criticizes Recall Petition Applicant

In a shocking development to the Recall Petition saga, MLA for Morinville-St Albert Dale Nally admits that he used privileged information in his Member Response to the petition filed to recall Nally.

Nally claims that Recall Petition Applicant Joshua Eberhart has never voted in a provincial election.

Mr Nally’s Nov 17 2025 letter to the Chief Electoral Officer reads

Dear Mr. McClure,

Warning: This document contains privileged information from Elections Alberta, and permission from Eberhart may be required before publication.

According to Elections Alberta data, Joshua Eberhart does not vote in provincial elections. The question then becomes how does someone who does not even vote get talked into leading a recall? I believe Mr. Eberhart acts as a proxy for Alberta Resistance, a left-wing activist group weaponizing recall legislation to target UCP MLAs and provoke a general election. This approach contradicts the spirit of recall legislation, and therefore, this application is without merit.

It is apparent that Mr Nally used not only one Voting Record but multiple Voting Records. Section 152(3) of Alberta’s Election Act says the Voting Record (as well as other election documents) may only be used for electoral purposes.

The Voting Record is defined in the Act as

a record containing the information described in section 17 that is used                               (i) to allow election officers to determine who is on the list of electors

(ii) to make any required updates to the personal information of electors, 

(iii) to add electors who have taken a declaration under section 100.4,

(iv) to record which electors have voted, and

(v) to make any required annotations regarding the voting process;

The Owl reached out to Petition Applicant Joshua Eberhart. He said he has spoken with a lawyer  and is unable to comment.

The Owl also reached out to MacKenzie Blyth (Manager of Strategic Communications, UCP caucus) for an explanation of UCP Policy in the use of Voting Records and if MLA Nally would be disciplined. We have received no response.

Critics are concerned that this may be a violation of the Election Act; voters are concerned that their voter information may be misused in other ways.
