Breaking News - Petition Applicant Responds to MLA Accusations

JOSHUA EBERHART, FOR MORINVILLE- ST. ALBERT MLA DALE NALLY

In order to set the record straight, I am forced to make this statement regarding my own personal information and in response to my own elected representative’s inaccurate statements about my voting information.
In 2021, then Premier Jason Kenney introduced the Recall Act because, in his words, it would put Albertan voters back in the driver’s seat. The UCP statements at the same time said that voters could “fire” their MLAs for breaking promises.
In 2025, Premier Danielle Smith’s government amended the Recall Act through Bill 54. These amendments made recall petitions somewhat easier, with lower thresholds. At no time did the UCP require a specific reason for recall, like they are now claiming.
I submitted a petition for recall against my UCP Member of the Legislative Assembly (MLA), the Honourable Dale Nally. My petition was approved because it complied with the legal requirements for these petitions under the recently amended Recall Act:
1. I was a resident of the electoral division (Morinville- St.Albert) for at least 3 months and an eligible voter in the Alberta provincial elections.
2. I included a statement about the reasons I believe a recall petition is warranted against Mr. Nally. This statement according to the UCP Recall Act can only be 100words.
3. I included the appointment for a Chief Financial OZicer
4. I paid the $500 fee
My reason for starting the recall petition was Bill 2 (the Back to School Act) which used the notwithstanding clause in the face of widespread public opposition and because MLA Nally did not consider this in participating in this UCP “overreach”. I posted about submitting my application and, following this, had a message from an organization called the Alberta Resistance. To be clear, they reached out after I submitted my application. I was not and am not working with Alberta Resistance, although I support what they do; I decided to organize this petition independently.
Under the UCP’s Recall Act, the MLA has an opportunity, although they are not required, to submit a statement in response. The MLA statement must be posted online according to the Chief Electoral Officer’s statement on the Recall Act.
Mr. Nally submitted a statement, in which he revealed three things:
1. He reviewed my voter information with Elections Alberta
2. From this, he alleges to have determined that I don’t vote in provincial elections.
3. He then alleges that, as an alleged non-voter, I must have been convinced to bring this petition by Alberta Resistance.
The first statement is one that I will be taking up with Elections Alberta through their complaint process and specifically whether Mr. Nally breached section 20 of the Elections Act by accessing my voter information for an unauthorized purpose. Whether I voted is irrelevant to the Recall Act and there was, in my submission, no purpose to accessing my voter information, certainly not a proper one.
The second and third statements are false. On May 29, 2023, the day of the last provincial election, I messaged my wife that I had voted and that it did not take long. I cannot recall when I started voting in provincial elections, but probably around 2019 when it became clear the stakes were rising. I am asking Elections Alberta to confirm, if possible, my voter identification number ‘s participation in the past elections.
Following Mr. Nally’s statement, Premier Smith said that Nally did access my data, but he was mistaken because, she claimed that I publicly stated that I “was not on the voter’s list, but (I) ended up voting”. First, I have not publicly stated that I was not on the voter’s list.
Second, the fact that Premier Smith appears to also know my voting information has led me to also seek Elections Alberta assistance to look at whether she was advised of my voter information or she too personally looked at this information.
